1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the Baby Muse mobile application and website (together, the "Service"), operated by CurlyCorn LLC. By using the Service you agree to these Terms. If you do not agree, please do not use the Service.

2. Description of Service

Baby Muse uses artificial intelligence to transform baby photos you provide into stylized keepsake images and short video clips — costumes, scenes, milestone art, and similar creative effects. You must be at least 18 years old and able to form a binding contract. The Service is designed for parents and legal guardians creating keepsakes of children in their care.

3. Your Content & Responsibilities

You keep all rights to the photos you upload and the keepsakes you create. By uploading a photo you grant us a limited, temporary license to process it solely to provide the Service (generating your keepsake). You represent that:

  • you own the photos you upload or have permission to use them;
  • for any photo of a child, you are the child's parent or legal guardian or have the guardian's explicit permission;
  • your use of the Service complies with applicable law.

No account is required to use the app. You are responsible for the device and app store account through which you make purchases.

4. Acceptable Use

You agree not to:

  • upload photos of children without parental or guardian authority;
  • create content that is sexual, violent, hateful, harassing, deceptive, or otherwise harmful — especially involving minors, which we report to authorities where required;
  • use the Service to impersonate or defame anyone;
  • reverse-engineer, scrape, resell, or overload the Service;
  • circumvent usage limits or payment requirements.

We may suspend or terminate access for violations of this section without refund.

5. Intellectual Property

Your Content

You retain ownership of the photos you upload and the keepsakes you generate. We claim no ownership over your content.

Our Content

The Service, including its software, design, themes, and branding, is owned by CurlyCorn LLC and its licensors. These Terms do not grant you any rights to our trademarks or to the Service's software beyond the personal, non-transferable right to use the app.

6. AI-Generated Content

Keepsakes are generated by artificial intelligence. Results vary and may occasionally contain artifacts or inaccuracies. Keepsakes are stylized artworks, not factual records. You are responsible for how you use and share the content you create.

7. Data Retention

Photos and generated images are temporarily stored on our servers and automatically deleted within 24 hours. Photos sent to our AI processing providers (fal.ai, Google Gemini, and Replicate) may be retained according to their respective data retention policies. Please refer to each provider's privacy policy for more information about their data handling practices. See also our Privacy Policy.

8. Subscriptions, Credits & Payments

8.1 Free First Keepsake & Subscription

Your first keepsake is free. Beyond that, photo and video generation requires an active Baby Muse Pro subscription, billed through your Apple or Google account.

8.2 Subscription Plans

  • Weekly Subscription: renews every 7 days
  • Annual Subscription: renews every 365 days (better value)

8.3 Credit System

Generations consume credits: standard photo 1 credit, Ultra photo 2 credits, 4K upscale 1 credit, videos 2–5 credits depending on length (plus 1 if the scene is transformed first). Your subscription includes:

  • Weekly allocation: 40 credits per week, resetting every 7 days from your subscription start. Weekly credits do NOT roll over; unused credits expire at the weekly reset.
  • Annual cap & Regeneration Mode: a maximum of 800 credits can be used per year. After 800 credits, you enter Regeneration Mode with 5 credits per week (instead of 40) until the annual period resets, 365 days from your subscription start.
  • Reset schedule: resets are based on YOUR subscription start date, not calendar dates.

8.4 One-Time Credit Purchases

Active subscribers can purchase additional credit packages (25, 60, 150, or 400 credits). Pricing varies by region and is shown in the app. One-time credits never expire and are used only after your subscription credits are exhausted.

8.5 Payment Terms

Subscriptions renew automatically until cancelled in your app store settings at least 24 hours before the end of the current period. Payments are processed by Apple or Google; except where required by law, payments are non-refundable, and refund requests are handled by Apple or Google under their policies.

8.6 Price Changes

We may change subscription or credit prices. Changes apply to new billing periods after reasonable notice; you can cancel before the change takes effect.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any particular generation will meet your expectations.

10. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose.

11. Indemnification

You agree to indemnify and hold harmless CurlyCorn LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

You may stop using the Service at any time; deleting the app removes your on-device data. We may suspend or terminate the Service or your access to it for breach of these Terms or where required by law.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law principles.

14. Changes to Terms

We may update these Terms from time to time. We will post the updated Terms here with a new effective date; material changes will be communicated in the app. Continued use after changes take effect constitutes acceptance.
